What is an Uncontested Divorce?

An uncontested divorce happens when both spouses agree on all key issues—such as property division, debt allocation, spousal support, and parenting arrangements. Because the terms are already resolved, the divorce process is mainly about filing paperwork with the court. It often works best when there are few assets or when spouses have already reached a separation agreement.

Uncontested divorce becomes difficult when disputes remain unresolved—such as disagreements about parenting schedules, hidden or complex finances, or reluctance by one party to cooperate. Most uncontested divorces take several months to complete, depending on the court’s processing times. Costs are significantly lower than a contested divorce, since fewer legal steps are involved.

Questions We Hear Often
